Part 5 Application Approval

Following amendments to the State Environmental Planning Policy (Major Development) 2005 in July 2009, Sydney Ports is responsible for the assessment and determination (Under Part 5 of the Environmental Planning and Assessment Act 1979) of applications for a port facility, environmental facility, community facility and environmental protection work undertaken at Port Botany provided the development has a capital investment value of less than $30 million.

When seeking a Part 5 Application Approval from Sydney Ports you will need to follow the Part 5 Approval Process. The process involves an initial meeting with Sydney Ports to confirm the development assessment and approvals process.

When requesting a Part 5 Application Approval from Sydney Ports all final documentation (assessment reports and plans) are to be submitted for review and determination, together with a completed Application Form. Sydney Ports will review the information provided and may request further information / documentation prior to determining the development proposal.
