Development Applications and Modification Amendments lodged with other authorities for approval (e.g. Department of Planning and Infrastructure and local councils)
Sydney Ports is required to issue a Permission to Lodge prior to lodgement of a Development Application (Part 4) or Development Modification Application (Schedule 6A or Section 96) under the Environmental Planning and Assessment Act 1979 by tenants and other external parties on land owned by Sydney Ports where Sydney Ports is not the determining authority under Part 5 of the Environmental Planning and Assessment Act 1979.
When requesting Permission to Lodge from Sydney Ports you will need to follow the Permission to Lodge process. This process includes providing Sydney Ports with all final documentation (reports and plans) which you are proposing to lodge for assessment with a local council or the Department of Planning and Infrastructure.
Sydney Ports will review the information provided and may request that amendments be made to the documentation prior to providing you with permission, to lodge the application with the relevant consent authority.

Once Permission to Lodge is issued, any further amendments made to the proposed development or documentation (i.e. reports and plans) are to undergo another review by Sydney Ports, prior to it being submitted to the local council or the Department of Planning & Infrastructure. This is to ensure that once development approval is granted, Sydney Ports has a copy of the final proposal and would allow the proposal to be constructed without requesting further amendments. A copy of the conditions of approval issued by the consent authority is to be provided to Sydney Ports for record keeping purposes.
Exempt and Complying Development
For certain minor developments, Sydney Ports may be able to advise if the development can be undertaken as exempt or complying development. Please note that the proposed development, even if it is determined to be exempt or complying development, is required to be reviewed by Sydney Ports and consent from Sydney Ports as the land owner is still required.
